class="MsoNormal">He left this mortal world on 05th of October, after a very long illness, leaving behind him his wife and two children. </p> <p class="MsoNormal">Mr Brahmkshtriya joined the Department in the Cadre of Income tax Inspector in 88-89 at Ahmedabad. He worked in the Investigation wing, Audit and Special Range at Ahmedabad. He was promoted as ITO in 2001 and was posted at Palanpur and then to Rajkot. </p> <p class="MsoNormal">Due to his illness he was transferred to Ahmedabad for the purpose treatment.</p> <p class="MsoNormal">Fondly known as BRHAMAJI in close circles, he was very soft-spoken, ever smiling and friendly personality. He was a very competent and intelligent Officer. The authorities under whom he worked during his relatively short-lived career held him in very high regards. Brahmastra means the ultimate weapon, it is considered the deadliest weapon. It is said that when a Brahmastra is discharged, there is neither a counter attack nor a defence that may stop it.<br /><br />The Investigation wing of the Department is blessed with the power to ignite the Brahmastra of Search and Seizure but the Assessing officers in the Central Charges are burdened with the responsibility to give a final and decisive shape to the use and effect of the Brahmastra of search in the from of a solid full proof Assessment Order.<br /><br />The Central Charges are the most important charges, are very very heavy in terms of work load and quantum involved and are also highly sensitive as it involves search assessments. The officer posted in a Central charge is expected to carry out a thorough verification of the voluminous seized material pulled up by a number of search parties without proper verification in many of the cases.<br /><br />During the assessment proceedings in central circles many assesses, having an experience of search action, becomes very tough and defiant. However in last few years it is seen that tendency of posting newly promoted ACsIT or inexperienced Officers in the Central Charges has developed. This is not best of practices and is also against the settled traditions of the Department.<br /><br />The posting in the Central Circle of a newly promoted AC normally comes as a shock to him which wipes of the joy of promotion. This is like a person who is up till now doing "one plus one equal to two " is suddenly asked to solve some "complicated equations". Though there is no dearth of talent, capacity and commitment in the newly promoted ACs, their first posting in central circles is a bit unfair to them. In many cases it is seen that due to lack of experience in handling big assessments they fail to match up to the expectations. This many times goes against them in terms of Audit,Inspections, Reviews and ACR. It is said that the lawyer of the UPSC has advised to wait for a certified copy of the order. The officers are not given posting of their <span style="font-style: italic;">first choice </span>even if there are enough number of vacancies in the Region of their first choice.<br /><br />For Examples many Income tax officers from Gujarat Charge have given Mumbai as their first or second choice . There were sufficient number of vacancies in Mumbai Region and these officers have never worked in Mumbai Region but they have not been posted in Mumbai.<br /><br />Why?<br /><br />What is the meaning of order of preference then?<br /><br />Secondly, many officers from Gujarat have given the first preference to Mumbai but only two officers have been posted in Mumbai. On what grounds others are not given the posting of their first preference?<br /><br />What criteria have been applied to decided this?<br /><br />Almost all the officers are given the posting in the Region of their third choice even though there are vacancies available in the Regions of their first/second choice. A few days back some Direct Recruit IRS officers filed petition before the Principal Bench of CAT regarding fixation of their interse seniority with Promotee IRS Officers of 2001 batch. Though the petitioner Direct Recruit Officers are Junior to the Promotee officers of 2001 batch they want their seniority to be fixed in between.<br /><br />It is now becoming a regular feature that every Panel for promotion has to pass through three clearance viz., C R (Bench Mark) Clearance, Vigilance Clearance (not once not twice but thrice) and the clearance from CAT. The trend is clear indication of poor human resource management. Either rules are not formulated properly or they are not implemented in true spirit. The problems regrading seniority have mainly arisen in the cadres of ITOs and ACsIT on account of mass promotions due to cadre restructuring in 2001. This is because in both the cases two groups viz cadres of ITOs of different states or the promotee and direct recruit ACs are merging together. The process of merger and rules governing the mergers seems to be at fault.<br /><br />Our leaders, however, have found out a wonderful solution to this problem. According to this representation in many CCIT (CCA) regions undue advantage has been given to the officers of their regions with regard to "deemed date of joining". The representation also seek to adopt a uniform policy with regard to the "date of joining" for all the regions. If the suggestions made in the detailed representation of ITGOA Gujarat are accepted and implemented there will be quite a big reshuffle in the inter se seniority of the 2001 batch ITOs. </span><br /><span style="font-family:georgia;"><br /><br />The seniority issue of 2001 batch is very sensitive and would lead to a series of litigations which may cause inordinate delays in promotions, if it is not handled properly. For that purpose, the administrative Ministries /Departments are required to send to the UPSC, DPC proposals complete with all relevant documents /information by July 15 of the year preceding vacancy year in case the vacancies are calculated on financial year basis and by April, 15 if the vacancies are calculated on calendar year basis. This time schedule is in respect of cases where approval of the Appointments Committee of the Cabinet (ACC) is required. <span style="font-style:italic;"> In respect of non-ACC cases, complete proposals are required to be sent to the Commission by July 31 of the year preceding the vacancy year where the vacancies are calculated on financial year basis and by April 30 if the vacancies are calculated on calendar year basis. All existing and clear expected vacancies in the concerned grade as well as chain vacancies on account of retirement etc., in the higher grades which can be clearly anticipated in the same vacancy year should be reported to the DPC. </span> It has further been provided that since the DPC would be convened in the year preceding the vacancy year, the DPC may have to consider some of the officers who are to retire in the vacancy year itself and there may also be similar other eventualities. The day after the promotion orders were uploaded, the officers who are promoted suddenly found themselves the busiest lot accepting congratulations from all quarters. The mobile phones kept on ringing from 9.30 PM of 17th Sept and are still ringing. All the friends, relatives,bosses present and past, colleagues, subordinates, well wishers so on and so-forth heartily congratulating these men of the hour.<br /><br />However, it is also an occasion of <span style="font-style:italic;">JYADA KHUSI but THODASA GUM.</span> for some of the officers. The orders brought lots happiness for them and their families but little sorrow also. Many may not be lucky to get the posting of their own liking out of their three choices. On the other hand for a few it was like <span style="font-style:italic;">KHUSHIYAN HI KHUSHIYA</span>. With the promotion they also got the Region of their prime choice. It is like <span style="font-style:italic;">Sone pe Suhaga</span>. Happiest are the people who got the postings in their parent regions. Lots of exception/relaxations are made in the posting orders. It is good to see. The benefits of relaxation, however, should be granted in every deserving case. Those who did not get their prime choice should not loose their hearts. If one do not get the thing of one's choice, he or she should choose what they have got. <br /><br />Some are in little confusion also. Our poor friend who was very restless over delay in getting promotion orders posed some uncomfortable questions. The Netaji then opened the secret that the ITGOA was forced to agree upon the withdrawal by ITEF. The Allahabad High Court did not grant the ill wish of Rajeev Mohan. Finally, the truth prevailed. “Time” is inching closer; we are heading closer and closer to the destination to which many of us are very keen to reach, as early as possible. And, why not? After all, the journey took 14 long years to reach us from one point to another. It is almost one fifth of our average life span. The wait after 11-12 years is like a punishment without commitment of any crime. <br /><br />Around 59 officers would be the worst suffers among the 160 odd. They could have been promoted in year 2008 itself but for some wrong calculation of vacancies they have to wait for two more years and are still waiting. Will they be compensated for the loss they have suffered for no fault of theirs? They are at a loss of seniority, pay and the most important thing the loss of two years in their careers. <br /><br />This is only one of numerous instances of injustice being done to us in the Department which we believe is our Department as much as it belongs to any other section of employees. Unfortunately we were not right. The story is that the Chairman was in the office yesterday at 10.30. a.m. sharp, after his foreign visit. The file was put up. He went to Revenue Secretary at around 1.00 P.M.By that time R.S. left the office for his half day leave. Thus file came back to the CBDT. Rajeev Mohan has filed or is going to file an appeal in the High Court of Allahabad against the order of CAT by which Special Heavy Penalty of Rs. 10,000/- was levied upon him for misleading the Court. It is also learnt from reliable sources that he is trying to get the hearing of his petition fixed on Monday, 13th September itself and to get an interim injunction on promotions. <br /><br />We, therefore, through our blog want to convey our concern to our beloved CHQ leaders. We understand that they are well seized off the latest developments and its possible undesirable implications. The interest of the person, who is trying to create trouble, is in no way going to be affected by the forthcoming promotions of ITOs to ACsIT. It would rather be in the interest of a larger section of the members of our Association that the promotion orders are released by this week end only. It is possible. The CHQ leaders with the co operation of the administration can make happen. The Leaders should immediately brief the acting Chairman/members of the Board about the liquid situation and should request them to expedite the promotion orders to avoid further delay which may be caused by fresh judicial intervention.<br /><br />We also appeal our Administration through this Post to give a sympathetic consideration to any request on the above lines,if made by our beloved Leaders.<br /><br />A link of this post is mailed to the Email Boxes of both the leaders and ITGOA’s official email id as soon as this blog is published on the internet. The ITGOA has taken a correct decision by sensing the pulse of its membership all over the Country. In our opinion the leaders of ITGOA have acted in a sensible manner this time. The membership of the ITGOA is more matured and far more senior than that of ITEF and is capable to differentiate between the right and the wrong. <br /> <br />The observations of the ITEF in circular no. 34 dated 03/09/2010 are more derogatory. This circular is about the withdrawal of the Agitation under the banner of JCA. The ITEF states as under:<br /><em>"We are aware of the difficulties and challenges in many charges due to the organisational weakness of our sister organisations and the concerted efforts on the part of some of its leaders to indulge in irrelevant and irrational propaganda to camouflage their organisational inability to make their members to participate in such historic struggles." </em> <br /><br />The democratic freedom of expression available to the members of ITGOA is highly misunderstood by the ITEF. The Members of the ITGOA are well educated and well informed. The observation of ITEF should be construed as an interference in the internal matters of our organistaion by an 'outsider. Our CHQ leaders should lodge a strong protest against such an unwarranted interference, if they feel it as "offensive remarks" like we do. <br /><br />As far as ITEF's decision to participate in so called "historic straggle" is concerned it reveals <em>Double Standards</em>. On the on hand the agitation of JCA has been withdrawn without any concrete results and on the other hand they are taking part in today's strike for so called "greater cause". The account of the meeting with member (P)given in the aforesaid circular (for details please refer ITEF's website)only indicates only the status of pendancy of each demand/issue, except the demand for Examination Rules. As per a news report published on Tax India Online while addressing a meeting of officers of the two main central revenue departments on 01/09/2010 at Mumbai, hon'ble Finance Minister Shri Pranab Mukherjee, once again advised both the Revenue Boards to improve human resource management to meet the raising expectations of the officers and the staff.He pointed out that improvement in holding DPCs is not satisfactory.He stressed the need to hold DPCs well in advance to keep the employees motivated and eager to perform their responsibility in the service of the Nation. The FM also observed that the Cadre Restructuring is also overdue and that it should be expedited to complete in a time bound manner.<br />*****************************************************************************<br /><br /> Friends, we are fortunate to have a person like him at the top of our organization. The Finance Minister is a perfect gentleman. His criticism for the status of Human Resource Management in our Department is in very polite manner. Otherwise as we all know no body is happy today. The processes of conducting DPCs in most of the cadres are not done in a smooth and timely manner. The calendar prescribed in this regard is not followed. Recent examples are as under;<br /><br /># The promotion orders of the ITOs to the cadre of ACIT are not made since October 2008. <br /><br /># The DPC of ACIT to DCIT is pending since very long. <br /><br /># The DPC of DCIT to JCIT is lingering for many moths. The benefit of relaxation for minimum period of service in the cadre of DCIT given by the DOPT to the ACITs of 2000 batch has been probably been washed away by the delay. If it has happened so it can be termed as criminal negligence. <br /><br /># The proposal for the promotion of Addl.CsIT to the cadre of CIT was sent on ad-hoc basis a few months back. The same is said to be also not getting through for quite a while.<br /><br /> The above instances are indicatives of the level of cadre management at the top of our organization. The DPCs and promotions seem to the last priority. Delays in the giving promotions has caused wide spread filling of frustration in the ranks and foils and throughout the cross sections of the Department.Due to which, as rightly pointed out by the F.M., the work of the Department has suffered a lot. Many of us have become like passengers waiting on a railway platform to catch a delayed train, simply waiting doing nothing. Aren’t we?<br /> <br /> Whatever may be the reasons for the delays, it seems that at present nobody holds moral responsibility for the work (DPC/Promotions) they have specially been appointed to perform. Over the past few years the situations have been allowed to escalate so much so that the employees and their associations are pushed to the path of agitations and strikes almost every year. (Premature withdrawal of agitations by leaders is a different issue though). Though, often we boast of being among the best managed Departments, it is highly unfortunate that the person of the stature of the Finance Minister has to point a finger on a very routine affair like timely DPCs and transfers. <br /><br /> The FM’s desire for both the Departments (CBDT and CBEC) to aim to become a model employer, which provide equal opportunities and equity in true sense is also significant in the background of the feeling shared amongst the Group B officers and the promotee IRS officers. It is now the responsibility of our Association to see to it that the above desire of Hon’ble F M is put in to practice in letter and spirit by the Administration. We are hopeful that the word of the Finance Minister does not go unheard this time.<br /><br /> From the speech of the F.M. one thing is for sure, he is well informed about the affairs of our Department, especially the hardships faced by the officers and staff. Full marks for that Sir! The speech is appealing to all of us!
