JCA Mobilisation Programme-A few Questions

Reg : JCA mobilization meeting on 21/06/2010

1. Last year JCA gave a call for one day strike on 26/11/2009, a notice for which was served on the Govt., on 05/11/2009. As per the charter of Demands there were 9 demands including demand for promotion to the cadre of AC and JC. The strike call was abruptly withdrawn by the JCA on 17/11/2009 stating that the MAJOR DEMAND is accepted by the Government. As per circular no 21 of ITEF (BlogSpot) only one demand regarding grant of higher grade pay of Rs. 4600/- to Inspectors. AO and PS was accepted. There was no clarification or even cursory mention of other 8 demands in the letter addressed to the members withdrawing the strike call.
In the light of above back ground and in view of the current call of Agitation given by the JCA we would like the officer bearer of the JCA and in Particular Com. Rajesh Menon the Secretary General of ITGOA to answer our following questions :
(1) Whether remaining 8 demands in the earlier charter of demand which include the demand for promotion to the cadre of AC and JCIT were minor demands in the eyes of the JCA and Central (HQ) ITGOA?

(2) If any of the remaining 8 demands was not minor/ insignificant the please clarify why the strike call was withdrawn at that time?


(3) Please clarify in the present charter of DEMANDS which demand is a Major Demand on fulfillment of which the JCA would withdraw its Agitation?

(4) Will the Secretary General Com Shri. Rajesh Menon give an assurance to the members of ITGOA present here that the strike shall not be withdrawn merely on the basis of oral assurances and promises which may subsequently be given by the CBDT
(5) In JCA circular dated 09/09/09 it is stated that JCA representatives will meet Chairman/ Member (P &V) once a week to expedite the issues/ demands. Whether they met Chairman/ member (p & V) 36 times. If so what is the outcome?

(6) Whether the call will be withdrawn if all the demands except the most legitimate, most important and having far reaching effects on the careers of all cadres i.e. Promotion to the cadres of AC and JCIT remains unfulfilled?


(7) The JCA is a common forum of ITEF and ITGOA and stated to fight for the rights and welfare of members of both the Associations. Please show us one single demand concerning the members of ITGOA which was accepted or fulfilled prior to decision taken by the JCA on 17/11/2009 to withdraw the strike called on 26/11/2009


2. Now coming to the latest CHARTER OF DEMAND formulated by the JCA the members here would like Com. Rajesh Menon to answer the following questions:

(1) Which is the MAJOR DEAMD according to the JCA in this Charter of Demand?
(2) Will the Agitation be called off on fulfillment of only one such Major Demand?
(3) Whether the demand of overdue Promotions to the Cadre of ACIT and JCIT is a MAJOR DEMAND or minor demand?
(4) Whether ITGOA has agreed for the impending Cadre Review of the Department and if so what steps have been taken by ITGOA to ensure that all existing vacancies are filled before given effect to the Cadre Review?
(5) Demand no 12 is regarding expediting the proposals submitted by the Cadre Review Committee. Members would like to know what exactly the proposals in their favour are and how the same would be beneficial for the career prospects of the members.

3. In the month of January 2010 a proposal was sent by the CBDT to hold DPC meeting for the Promotions to the cadre of ACIT and the leader of central HQ were taking credit for the same. However later after two/three months and after raising several quarries UPSC returned the entire proposal back to the CBDT as the same was found defective by the UPSC. In this regard the members here would like com Rajesh Menon to answer their following questions:

1) Why despite 100 sponsored visits, as they claim the leaders of ITGOA at CHQ could not ensure a simple error free proposal to the UPSC?
2) What are the details regarding efforts made by the ITGOA for resolving the queries raised by the UPSC?
3) Who on the side of Administration is responsible for submitting such defective and erroneous proposal?
4) What action is being proposed to be taken by the ITGOA against the Officials and officers who are responsible for sending defective proposals time and again?
4. Every time the members of ITGOA have to beg and struggle for timely promotions in Group A service. Com Rajesh Menon being the Secretary General may through some light as to when and how the Leaders of Our Association will ensure that every time the members do not have to struggle and fight for their legitimate right of timely promotions to the cadre of ACIT and further?

5. Whether the Leaders of CHQ are aware of the DOPT’s O.M NO. 22011/3/91 dated 13/05/91 regarding holding DPC meeting for promotion to various cadres?

6. If yes then com Menon may please state whether any point of time the administration was asked by our association to comply with the direction issued by the DOPT?

7. If the leaders are unaware of such important direction issued by the DOPT in favour of the Government Employees what justification do they have to hold and continue at such important and crucial posts of our Association?

8. Above mentioned DOPT Memo reads as under :

“Very often, action for holding DPC meeting is initiated after a vacancy has arisen. This results in an undue delay in the filling up of the vacancy causing dissatisfaction among those who are eligible for promotion. It may be ensured that regular meetings of DPC are held every year for each category of posts so that an approved select panel is available in advance for making promotions against vacancies arising over a year.”

“The requirement of convening annual meetings of the DPC should be dispensed with only after a certificate has been issued by the appointing authority that there are no vacancies to be filled by promotions or no officers are due for confirmation during the year in question”



9 As regards the priorities of demands in the of the Charter of Demand drafted by the JCA

1. The demand of mobile phone reimbursement of Rs. 500/- per month has been palceed at no 1 in the Charter of Demand. There will be financial benefit of only Rs. 6000/- per annum to the beneficial employee.

2. The demand of desktop computers to each employee seems to be highly irrelevant and outdated as there are hundreds of computers gathering dust over quite a period of time and the Administration would be more than happy to allot them to persons who requires demands and wants to work on computer

It is highly unfortunate that this kind of demands are given priority over the other demands like timely promotions, removal of anomalies in pay structure which are of the real importance to the members of both the associations. The drafting of CHARTER OF DEMAND it self show that what are the priorities of the JCA.
