JCA Mobilisation Programme-A few Questions

Reg : JCA mobilization meeting on 21/06/2010

1. Last year JCA gave a call for one day strike on 26/11/2009, a notice for which was served on the Govt., on 05/11/2009. As per the charter of Demands there were 9 demands including demand for promotion to the cadre of AC and JC. The strike call was abruptly withdrawn by the JCA on 17/11/2009 stating that the MAJOR DEMAND is accepted by the Government. As per circular no 21 of ITEF (BlogSpot) only one demand regarding grant of higher grade pay of Rs. 4600/- to Inspectors. AO and PS was accepted. There was no clarification or even cursory mention of other 8 demands in the letter addressed to the members withdrawing the strike call.
In the light of above back ground and in view of the current call of Agitation given by the JCA we would like the officer bearer of the JCA and in Particular Com. Rajesh Menon the Secretary General of ITGOA to answer our following questions :
(1) Whether remaining 8 demands in the earlier charter of demand which include the demand for promotion to the cadre of AC and JCIT were minor demands in the eyes of the JCA and Central (HQ) ITGOA?

(2) If any of the remaining 8 demands was not minor/ insignificant the please clarify why the strike call was withdrawn at that time?


(3) Please clarify in the present charter of DEMANDS which demand is a Major Demand on fulfillment of which the JCA would withdraw its Agitation?

(4) Will the Secretary General Com Shri. Rajesh Menon give an assurance to the members of ITGOA present here that the strike shall not be withdrawn merely on the basis of oral assurances and promises which may subsequently be given by the CBDT
(5) In JCA circular dated 09/09/09 it is stated that JCA representatives will meet Chairman/ Member (P &V) once a week to expedite the issues/ demands. Whether they met Chairman/ member (p & V) 36 times. If so what is the outcome?

(6) Whether the call will be withdrawn if all the demands except the most legitimate, most important and having far reaching effects on the careers of all cadres i.e. Promotion to the cadres of AC and JCIT remains unfulfilled?


(7) The JCA is a common forum of ITEF and ITGOA and stated to fight for the rights and welfare of members of both the Associations. Please show us one single demand concerning the members of ITGOA which was accepted or fulfilled prior to decision taken by the JCA on 17/11/2009 to withdraw the strike called on 26/11/2009


2. Now coming to the latest CHARTER OF DEMAND formulated by the JCA the members here would like Com. Rajesh Menon to answer the following questions:

(1) Which is the MAJOR DEAMD according to the JCA in this Charter of Demand?
(2) Will the Agitation be called off on fulfillment of only one such Major Demand?
(3) Whether the demand of overdue Promotions to the Cadre of ACIT and JCIT is a MAJOR DEMAND or minor demand?
(4) Whether ITGOA has agreed for the impending Cadre Review of the Department and if so what steps have been taken by ITGOA to ensure that all existing vacancies are filled before given effect to the Cadre Review?
(5) Demand no 12 is regarding expediting the proposals submitted by the Cadre Review Committee. Members would like to know what exactly the proposals in their favour are and how the same would be beneficial for the career prospects of the members.

3. In the month of January 2010 a proposal was sent by the CBDT to hold DPC meeting for the Promotions to the cadre of ACIT and the leader of central HQ were taking credit for the same. However later after two/three months and after raising several quarries UPSC returned the entire proposal back to the CBDT as the same was found defective by the UPSC. In this regard the members here would like com Rajesh Menon to answer their following questions:

1) Why despite 100 sponsored visits, as they claim the leaders of ITGOA at CHQ could not ensure a simple error free proposal to the UPSC?
2) What are the details regarding efforts made by the ITGOA for resolving the queries raised by the UPSC?
3) Who on the side of Administration is responsible for submitting such defective and erroneous proposal?
4) What action is being proposed to be taken by the ITGOA against the Officials and officers who are responsible for sending defective proposals time and again?
4. Every time the members of ITGOA have to beg and struggle for timely promotions in Group A service. Com Rajesh Menon being the Secretary General may through some light as to when and how the Leaders of Our Association will ensure that every time the members do not have to struggle and fight for their legitimate right of timely promotions to the cadre of ACIT and further?

5. Whether the Leaders of CHQ are aware of the DOPT’s O.M NO. 22011/3/91 dated 13/05/91 regarding holding DPC meeting for promotion to various cadres?

6. If yes then com Menon may please state whether any point of time the administration was asked by our association to comply with the direction issued by the DOPT?

7. If the leaders are unaware of such important direction issued by the DOPT in favour of the Government Employees what justification do they have to hold and continue at such important and crucial posts of our Association?

8. Above mentioned DOPT Memo reads as under :

“Very often, action for holding DPC meeting is initiated after a vacancy has arisen. This results in an undue delay in the filling up of the vacancy causing dissatisfaction among those who are eligible for promotion. It may be ensured that regular meetings of DPC are held every year for each category of posts so that an approved select panel is available in advance for making promotions against vacancies arising over a year.”

“The requirement of convening annual meetings of the DPC should be dispensed with only after a certificate has been issued by the appointing authority that there are no vacancies to be filled by promotions or no officers are due for confirmation during the year in question”



9 As regards the priorities of demands in the of the Charter of Demand drafted by the JCA

1. The demand of mobile phone reimbursement of Rs. 500/- per month has been palceed at no 1 in the Charter of Demand. There will be financial benefit of only Rs. 6000/- per annum to the beneficial employee.

2. The demand of desktop computers to each employee seems to be highly irrelevant and outdated as there are hundreds of computers gathering dust over quite a period of time and the Administration would be more than happy to allot them to persons who requires demands and wants to work on computer

It is highly unfortunate that this kind of demands are given priority over the other demands like timely promotions, removal of anomalies in pay structure which are of the real importance to the members of both the associations. The drafting of CHARTER OF DEMAND it self show that what are the priorities of the JCA.

Sub: Inordinate delay in holding DPC for promotion to the post of ACIT – regarding

Dear friends and Colleagues,

We the below named senior most ITOs of Gujarat region crave liberty to convey our regards and best wishes to all the ITOs of your region. The purpose behind sending this communication to all of you is to create awareness amongst ourselves regarding injustice that has been meted out in giving promotions to us to the cadre of ACIT. To delay the DPC beyond the limit of tolerance is now becoming a regular feature. Holding DPCs biannually seems to be a regular practice as last DPC was held in 2008 and that too was for two years. As we know DPC for R.Y. 09-10 has been kept on hold for no cogent reason since last few months. Leaders at the central HQ have a crucial role to play in getting the DPCs conducted as per the calendar prescribed by the UPSC. We here in Gujarat have been in constant touch with the all India president of ITGOA since last 6 months or so. We have time and again conveyed our concerns telephonically as well as by sending SMS. However the leaders have failed miserably to impress upon the authorities to stick to the DPC Calendar. It is now felt that leaders are disinterested in protecting the interest of the members or rather they have their own agenda.
2. We were being told again and again that the Secretary General ITGOA is actively pursuing this matter and in this connection he has visited New Delhi more than 100 times. This fact is also reiterated in the minutes of the General Body meeting of ITGOA held at Hyderabad. However no meaningful purpose seems to have been served despite more than 100 visit of the Secretary General. Do these 100 visits to New Delhi at the expense of the members, reflect the commitment of the leaders or does it reflect the utter incompetence of the leaders, is a question which any honorable leader should answer at the earliest. However no official communication regarding the steps taken since last six months, progress made and so called hurdles faced leading to inordinate delay of DPC has been given by the ITGOA till date. In fact the Web-site of the ITGOA has never been updated since past couple of years. On the hand the web-site of ITEF is updated regularly.
3. The other most important question which requires to be answered is that why despite these 100 sponsored visits, the same leaders could not ensure a simple error free proposal to UPSC, which is being again and again returned back due to defects. The inordinate delay is not only leading to uncertainty and causing mental hardship to senior ITO’s who are on the verge of promotion but many ITO’s have also been deprived of promotion as they have retired without getting promotion, which was their fundamental right. It is seen that since April, 2009 42 ITO’s who were in zone for consideration of promotion have retired without getting promotion. Not only this the delay in promotion is also jeopardizing the future career prospects of all our colleague ITO’s for whom the wait for promotion is between 12 to 14 years. Many ITO’s in Gujarat will be completing 14 Years in the same post by the end of June, 2010.
4. Thus, it is now high time for all of us to be united and fight for justice. It is therefore, proposed that we insist for an Extraordinary General Body Meeting to be informed about the steps taken by our Association to secure our due career prospects and also decide about future course of action in light of unjustified delay tactics adopted by the CBDT. It is in the interest of all of us. Your cooperation in this regard is highly solicited and all the units of ITGOA are therefore requested to make collective efforts to get the Extra Ordinary General Meeting convened as early as possible and impress upon our leadership the need to get up from their slumber and act fast to secure the interests of its members.
5. In the light of above facts a notice to call for an Extraordinary General Body Meeting is being sent to the General Secretary ITGOA New Delhi simultaneously and he is being requested to appraise the members on the following point with documentary evidence.
1. Details and copies of correspondence made with CBDT and Office of the ADVI since April 2009 onwards with reference to DPC for posts of ACsIT for review DPC for RY 2008-09 and regular DPC for RY 2009-10.

2. Details of meetings held with Chairman CBDT, the Member P & V and the Under Secretary AD VI right from April 2009 onwards since we have been told again and again that Secretary General ITGOA has visited New Delhi more than 100 times in the last one year.

3. Date on which the composite proposal for DPC was initially sent to UPSC.

4. Date wise details of queries raised by the UPSC on DPC proposal and replies given by the CBDT/ AD-VI in this regard with documentary evidences.

5. Evidence regarding efforts made by the ITGOA for resolving the queries raised by the UPSC.

6. What action is being proposed to be taken by the ITGOA against the Officials who are responsible for sending defective proposals time and again.

7. What action ITGOA proposes to take against CBDT for their callous behavior for delaying the DPC.

8. Efforts made by the ITGOA to get the responsibility fixed for the inordinate delay for conducting the DPC which is in total contravention of rules framed by the UPSC.

9. Whether ITGOA has agreed for the impending Cadre Review of the Department and if so what steps have been taken by ITGOA to ensure that all existing vacancies are filled before given effect to the Cadre Review?

6. This letter is being sent to all ITGOA units of all the states along with a copy of proposal sent to General Secretary, ITGOA, New Delhi calling for an Extra Ordinary General Body Meeting of ITGOA. You are requested to kindly discuss this matter with all your colleagues who are on the verge of promotion and if they are also in agreement with what has been stated above and are also concerned about the inordinate delay of their promotion then a similar proposal, calling for immediate holding of EGM may moved from your side also. Sub : Inordinate delay in holding DPC for promotion to the post of ACIT – regarding


The below signed officers of Gujarat Unit, who only represent a cross section of large number of senior ITOs, who are on the verge of promotion to the cadre of ACIT are deeply distressed due to the inordinate delay in holding the DPC meeting for promotion to the cadre of ACIT. This letter is primarily intended to convey our deep anguish to the Executive Committee members of ITGOA in their failure to get issues resolved for conducting the DPC in time. It has been the practice in the past that DPCs to the post of ACIT are not being conducted by the CBDT on a regular basis on the basis of prescribed norms. Now it has been felt that even when proposal are sent, such proposals are submitted very casually not meeting with the requirements prescribed by the UPSC, as a result of which, the proposals are returned several times. We understand that the ITGOA, which is the only representative body of the promotee officers of the Department has done precious little to ensure that CBDT takes prompt action in conducting DPCs in time.

2. In the above background, we, along with several other members of other Units call upon the Secretary General of ITGOA to immediately convene an Extra Ordinary General Body meeting to inform the members about the steps taken by the Association to secure our career prospects and also to decide upon the future course of action in the present scenario.

3. We are hopeful that the Executive Committee of the Association will fully understand the gravity of the situation and issue a notice for convening the Extra Ordinary General Body meeting, preferably at Ahmedabad for the above purpose.

4. A copy of the letter addressed to other Units, in which we have shared our feelings is also sent herewith for information and incorporating in the agenda of the proposed Extra Ordinary General Body Meeting.

Reply to Mr. M Vivekanand Tamilnadu and Pondichery Unit of ITGOA

Dear Mr. M. Vivekanandji,

We are thankful to you for the reply mail and reminding us again the need for standing united. We apologize to you for slight delay in sending the reply as we had to contact all ITO’s of this region who are due for promotion before sending you the reply. Before commenting upon the contents of your mail we would once again like to reiterate that the contents of our letter dated 17-05-2010 and later mail which was sent to you were not of any individual here. It was collective view and apprehensions of all ITO’s of Gujarat who are due for promotion in the proposed DPC and those who are next in line for promotion. Our this view has already been ratified in the letter dated 19-05-2010 written by the General secretary, ITGOA, Gujarat Unit to the Gen. Sec. ITGOA, New Delhi who has also called for an early convening of EGM on this issue. (Copy of his letter is again attached herewith)

2. It is further clarified that the letter written by the Gen. Sec. of ITGOA, Gujarat Region was on the basis of a detailed representation from the senior most ITOs of the Charge (they have mailed a copy of the same to all the units of ITGOA and for that matter to your unit also). The facts mentioned therein have been found to be commensurate with the ground reality prevailing over various burning issues concerning the members of our association not only in Gujarat but also all over India. Not only this, the issue of promotion is also emotionally attached to the family members of ITO’s also, many of whom have their grown up children studying in higher classes. In that matter defence forces are better than our department because the there the formalities of promotions and transfers are completed before March every year so that the children of defence personals get admissions at new places before the start of the academic session. In our Dept. nobody bothers and cares about it. In view of above facts a considered decision was taken by the Gujarat Unit to request all the units of ITGOA to call for an Extra Ordinary General Body Meeting so that the Leaders of the Central HQ get an opportunity to come clean if they are so. Also this would provide a golden opportunity to the leaders to interact directly with the members of the association and to explain about the pains that they might have taken for the welfare of the members instead of propagating their achievements through indirect sources.

3. Dear friend, we also partially agree with your observation “the delay in DPC was on account of various factors which were not always in our control all the time”. All the “various factors” however are never made known to the members by the leaders. The leaders are really not in control of the situation in letter and spirit otherwise they would not have taken hundreds of rounds (as they claim) to the CBDT with no concrete outcome except spreading rumors about the dates of DPC (remember, 12th to 14th May at Mumbai ! Humm!). Now one more rumor is being spread that proposal would be sent by 31st May and DPC would be conducted by 15th June. There is no basis of this rumor as there is no movement of any file in CBDT regarding our promotion matter.

4. In para 3 of your mail you have stated that members of your unit have not advocated any precipitative action despite their anger, frustration, disappointment etc. Here we would like to clarify that we too in our letters have never advocated for any precipitative action except calling for an EGM where our leaders could explain the cause of inordinate delay of DPC and steps taken by them in the course of more that 100 visits to Delhi.

5. In para 6 of your mail you have asked us to elaborate on the issue of emotional detachment of ITGOA. In this regard it is once again regretfully stated that not a single Member of the Central HQ of ITGOA has cared to give any explanation/reply in regard to issues raised in our letters dated 17-05-2010, which was signed by 43 ITOs of Gujarat Region, who are in Consideration Zone for promotion to the cadre of ACIT. Besides, large number of officers of Gujarat Region as well as other Regions too shared the same feelings, which are expressed in our letter wherein following questions were raised.

What more elaboration of emotional detachment is required on it as reply to not a single question is received till date. Not only this, nobody has cared to even talk to us also. In fact had our leaders briefed all its members of the efforts being made by them for an early DPC and difficulties being actually faced by them, we would not have bothered Gentleman like you by sending email etc.

6. We have repeatedly referred back our earlier mail with the specific purpose of finding out precisely what it was which could be termed as Derogatory or Defamatory. Non of the members of the ITGOA, Gujarat Unit have been successful in such identification. Hence you may please identify the same and communicate with us. In fact there is nothing in the Email which could even border upon the derogatory or defamatory. As regards the telephone calls, the same were made by the members of ITGOA, Gujarat Unit for the limited purpose of confirming whether Email and FAX sent have been received or not. We feel there is nothing derogatory or defamatory in just confirming the receipt of a mail or fax from an office bearer of ITGOA. As regards the Emails being sent to your personal address we think you are forgetting that it is the official Web-site of ITGOA which carries the email addresses of office bearers of all units of ITGOA. It is from this site only that the addresses were retrieved and mails were sent to office bearers of all state units. Non of the office bearer, except only you, have objected to it. The office bearers of all states units, Except only you, have welcomed our movement and promised to extend their support also. As regards our identification you are once again forgetting and ignoring the fact that our mail and fax letters dated 17-05-2010 were duly accompanied with names and signatures of all the members of ITGOA, Gujarat Unit. In fact we would be pleased to know the names of the members of ITGOA, Tamil Nadu & Pondicherry Unit who have resigned themselves to their fate by supporting the views expressed in your mail. It may further be mentioned that the remark made by you in your previous mail stating our action of calling for an EGM as “Reactive and chivalrous approach against our leadership” can also be termed as Derogatory and Defamatory however we won’t proceed legally on it as it would defeat our purpose and in turn help those who are against an early DPC.
